The Law Offices of Randall M. Weiner obtained a settlement for the Smokebrush Foundation for the Arts, for contamination created by the City of Colorado Springs. The settlement requires Colorado Springs or its successor to take steps to remediate coal tar (Town Gas) contamination potentially migrating to the Trestle Building, near America the Beautiful Park and the new U.S. Olympic & Paralympic Museum, plus pay Plaintiffs $500,000.
Our 7-year case went up to the Colorado Supreme Court and established that Colorado, its counties and cities are not immune from lawsuits for contamination they created that predates the 1970’s enactment of the Colorado Government Immunity Act.
