Wrongful death is a distinct specialty within personal injury law. Wrongful death cases typically involve two elements:
- (1) a claim under Colorado’s Wrongful Death Act on behalf of spouse of the decedent, the heirs of the decedent (child or lineal decedent), or a designated beneficiary of the decedent, and
- (2) a claim for reimbursement of the decedent’s final expenses, including funeral expenses, on behalf of the decedent’s estate under Colorado’s Survival Statute.
